Ham Sandwich With A Side Of Lies

As it turns out, I didn't have the whole story when I wrote yesterday's post. Barry Bonds did have immunity when he went before the second grand jury. His only problem is that even though he was immune from prosecution, if he told the truth, he didn't, four times according to the new indictment. Stupid man.

Could he have taken the fifth and said nothing? Do you have the right against self-incrimination when you have immunity and aren't being incriminated?

Invoking your Fifth Amendment rights is "trumped" by an offer of immunity. The point of the Amendment is that you should not have to testify against your self. If the testimony can't harm you, given immunity, there's no need to give you protection. Then the Government's interest in discovering the truth outweighs your interest in not saying embarrassing and otherwise criminal things about yourself.
